In order to participate in the contest, interested individuals must submit an application with an image/sketch and a brief description of the artwork design that is proposed for the contest. Applicants will be notified prior to the event whether they are accepted. Only artists who have submitted an application, along with an image/sketch and description, will be considered. The image/sketch submitted with the application must be substantially the same as the artwork which is created during the contest. An entry may be disqualified if not substantially similar to the image submitted with the application.
The designated theme for all works is “Pieces of Warrensburg.” All proposed entries must be focused on this theme in order to be accepted for the competition.
All artwork must be appropriate for public viewing by all ages.
Artwork shall not contain any depiction of or characterizations which suggest, depict, or promote, in any form, nudity or semi-nudity, profanity, obscenity or lewdness, graphic violence, gore, glorification of violence or acts of a violent nature, discrimination, the use of hate speech against any individual, group, company, or organization, or any other language or descriptive material which taken in form and context is deemed to be contrary to community standards. No work will depict or promote any substance regulated or controlled by the State or Federal government or whose use is dependent upon age.
Artwork shall not contain any words, messages, or symbols that advertise products/services or which advocate, express, or endorse any political message or viewpoint.
All submissions must be original designs created by the artists submitting them. Artist represents that the artwork does not contain any third-party copyrighted materials or any other legally protected property, including, but not limited to, images and wording.
The City of Warrensburg has the right to disqualify and/or remove any artwork deemed to be in violation of these rules.
Sidewalk chalk art spaces will be assigned by event organizers. Artists may not switch spots with other artists without permission from the event organizers.
Artwork shall not exceed the allotted space.
Artists must provide their own sidewalk chalk for the contest. No other medium may be used.
Artist retains the copyright of their submission and the right to use the artwork for the Artist’s personal use. However, you grant the City of Warrensburg and Warrensburg Main Street a royalty-free, perpetual, irrevocable, and non-exclusive license to reproduce, distribute, and publicly display submitted artwork or parts thereof for advertising, promotional, and other purposes, including resale items and the right to create derivative works of your entries, in whole or in part in any media now existing or subsequently developed. Artists may or may not be credited when the artwork is used.
By participating, Artist expressly and forever waives any rights Artist may have pursuant to the Visual Artists Rights Act of 1990 (“VARA”), 17 U.S.C. § 106A, including any rights under 17 U.S.C. §113, regarding the artwork. Specifically, Artist agrees that the City has the absolute and perpetual right, in its sole discretion, to permanently remove the artwork from public display for any or no reason. Any “moral rights” existing under other laws are waived, and Artist agrees that the City of Warrensburg may remove the work at any time.
In the event of inclement weather, the City of Warrensburg reserves the right to cancel the contest, and the contest will not be rescheduled.
